The Minister of Employment and Labour has declared that the Dispute Resolution Collective Agreement and the Registration and Administration Expenses Agreement which were concluded in the Bargaining Council for the Civil Engineering Industry as set out in the Schedule to this Notice be extended to non-parties. This means that the conditions specified therein shall be binding on the parties concluding the collective agreement and other employers and employees in that industry.
The objective of the extension of the Registration and Administration agreement is to provide for the expenses of the BCCEI, which shall be vested in and administered by the BCCEI, and for the registration of all employees engaged in the industry. Any person bound by this agreement may apply to the BCCEI independent Exemption Committee for an exemption for any provision in this agreement in the manner provided for in the BCCEI Exemption Collective Agreement.
Notwithstanding the extension of the Dispute Resolution Agreement, parties may agree to meet in an attempt to resolve any dispute between them. They may consider appointing, at their own cost, a mediator or arbitrator, or referring the dispute to any other process as agreed between them. Nothing prevents the parties to a dispute from establishing, by agreement, their own dispute resolution procedures.
The collective agreements come into effect from the 7th of August 2023 for the period ending 31 August 2028.
