Newsflash: Building Industry (Cape of Good Hope) Collective Agreement Extended to Non-Parties
The Department of Employment and Labour has formally extended the scope of the Building Industry Bargaining Council (Cape of Good Hope) Collective Agreement to include all employers and employees within the industry, irrespective of their party status. This extension is effected through Government Notice No. R. 6498, published in Government Gazette No. 53145 on 12 August 2025.
The extended agreement will come into operation on 1 November 2025 and remain in force until 31 October 2028. It replaces the previous extension notice (GN R. 3667 of 14 July 2023), which has been officially cancelled.
A correction notice (GN R. 6516 of 15 August 2025) has been issued to clarify the effective dates and confirm the cancellation of the prior notice.
The extended agreement introduces binding provisions across the Cape of Good Hope region, including but not limited to:
- Minimum wage structures and employment classifications
- Working hours, overtime, and leave entitlements
- Health and safety obligations
- Subcontracting protocols and joint liability provisions
- Employee benefit schemes (including pension, medical aid, holiday and bonus funds)
- Codes of Good Practice for temporary lay-offs and Expanded Public Works Programme (EPWP) compliance
This extension reinforces the Department’s commitment to promoting fair labour standards, ensuring uniformity across the sector, and safeguarding the rights of all workers in the building industry.
Employers are urged to review the full agreement and ensure compliance with its provisions. Non-compliance may result in enforcement action, including penalties and arbitration.
