Notice of the extension of the operation period of the Main Collective Agreement concluded for the Bargaining Council for the Fishing Industry

On 20 October 2023, the Minister of Employment and Labour published a notice extending the operation of the Main Collective Agreement to non-parties. The application of the Main Collective Agreement was initially for the period from 31 October 2023 to 30 September 2024. The Director for Collective Bargaining, duly authorised by the Minister of Employment and Labour, has in terms of section 32(6)(a)(i) of the Labour Relations Act No. 66 of 1995 further extended this period by a further period ending on 31 December 2024.

 

The Main Collective Agreement applies to all employers and/or employees within the Republic of South Africa, who are members of any of the parties to the Agreement, as well as non-parties who are employed in the Hake Deep-Sea Bottom Trawl Sector, Hake Inshore Bottom Trawl Sector, and the Horse Mackerel Mid-Water Trawl Sector.

 

Any employer to whom this agreement is extended may apply to the Bargaining Council’s Executive Committee for exemption from the terms of the agreement in terms of clause 37 thereof.
