Enforcement in 2026

Fines and non-compliance penalties of up to 10% of annual turnover remain unchanged, but the standards that organisations are now held to have shifted significantly, creating greater compliance pressure across sectors.

New Plans Required by 1 Sept 2026

EE Plans need to be aligned to the new sector-specific numerical targets since this date. Non-compliance now carries significant risk heading into 2026, with increased scrutiny from regulators and stakeholders.

Courts Have Upheld the Targets

Challenges to the regulations were dismissed by the High Court (August 2025), Constitutional Court, and Supreme Court of Appeal (March 2026). Sectoral targets are now legally binding, and compliance is mandatory.

31 August closes the measurement period/first full reporting cycle under the amended EEA, with the reporting window opening on 1 September.
