Important Notice: Parental Leave and UIF

In November 2018 President Ramaphosa signed a new type of leave, Parental Leave, into law. It has not become effective as President Ramaphosa did not announce a date. The reason is during a period of parental leave, parents who are contributing to UIF are entitled to claim from UIF according to the amendments made in Section 7, 8, 12, 13, 15, and 16 of the Labour Laws Amendment Act. The UIF department had to upgrade their systems, develop regulations and design new forms in order to process the applications. The upgrades to the system have already started and their expected implementation date is September 2019. This means that employees applying for parental leave may only withdraw UIF possibly from September 2019. Companies who have implemented Parental Leave should be aware that their employees cannot withdraw UIF for Parental leave.
